2. Information Automatically Collected
We automatically receive certain types of information, some of which may be associated with personal information, when you visit our websites or use our products and services.
Information Related to Your Location and Route or Other User Content
Each time you access the GPS Floto service or our partnered branded versions of GPS Floto services, we record your route information, including your point of origin (which may be your then-current location), the address of your destination, the starting time of your trip, and the route you are undergoing as well as information about car that have been used. We maintain a database with these locations and route information, and may keep such information indefinitely to improve our Services and to provide other features that may enhance your service capabilities, functions, and your user experience. We may periodically receive your current location from the GPS hardware associated with your wireless device for the purpose of providing enhanced services. When your location and speed is used for these purposes, we anonymize them by striping it of all personal identity information prior to storing.
Some versions of our Services include a location and information sharing feature that enables you to send your location or other information to another party. These location exchanges are transmitted via the internet or text messages using Short Messaging Service (SMS). We record these location exchanges, and may keep such information indefinitely.
For some applications we may save this location information until you replace it or elect to delete your account. Upon termination of our Services, all your private data in your profile will be removed. However, information regarding yourself in connection with any particular event shall remain available within the applicable service, but shall remain available solely in connection with the event. Any other user submission data, email, or other such service interaction shall be removed from the applicable service, and shall no longer be available to you or other members of such service. Your private data will no longer be available at your profile after its deletion, and stored location based data will be anonymous for future usage. However your private details may be stored for limited time (stripped of location positioning data) for billing purposes, and TLV tax control.
Cookies and Similar Technologies on the Website and TLV Applications
We may employ browser cookies or similar technologies to identify the computer, mobile device, or some of our Services and record your preferences and other data. We use cookies or similar technologies to evaluate how our websites, devices or applications are used and to provide continuous improvement to our Services, make recommendations, and complete transactions you request. Cookies may be stored locally on mobile devices or on computer servers operated or controlled by third party vendors of TLV. We may use a tracking pixel, agent or other visitor identification technology that collects anonymous data about your use of some of our Services. In addition, when you visit our website our systems automatically collect your IP address and the type of browser that you use. When you browse our website, our systems log the TLV web pages that you visit. Server log files are records of activity automatically created by the server and stored. If we combine or link cookie or Web beacons with personal information, we will treat the combined or linked information as personal information under this policy. We may employ third-parties to place advertisements about our products and services on other web sites. The use of cookies or other similar technologies by such third parties is governed by their privacy policies.
You may limit the automatic collection of certain information by our website by disabling the cookies using your browser options. Please be aware that disabling cookies may prevent you from using specific features on our websites, such as ordering services, or maintaining an online account.
Other Information
When using GPS Floto application or website, we may collect and store information about your hardware device, installed software (e.g. operating system version), IP address, mobile equipment model and mobile telecommunications provider.
We may retain any data you provide to us in an email inquiry, for the purpose of tracking the types of questions we receive and to answer them.
Google AdWords Remarketing
AdWords Remarketing is a Remarketing and Behavioral Targeting service provided by Google. It connects the activity of www.gpsfloto.com with the Adwords advertising network and the Doubleclick Cookie.
This website uses the Google AdWords Remarketing service to advertise on third party websites (including Google) to previous visitors to our site. It means that we advertise to previous visitors who haven't completed a task on our site, for example order a pricing plan and didn't pay. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the GPS Floto website. Any data collected will be used in accordance with our own privacy policy and Google's privacy policy.
You may opt out of Google's use of cookies by visiting the Google's Ads Settings. Google has additional information available about their Remarketing Privacy Guidelines, Policies, and Restrictions.
3. Information from Other Sources
We may obtain information about you from outside sources and add to it or combine it with your personal information. For example, we may collect demographic and marketing data about you from third parties for marketing research and analysis to improve our products/services, obtain updated address information from our shippers, or collect information from other vendors that promote and distribute our products through their own brands.
When and With Whom Your Information Is Shared or Disclosed
TLV does not sell, rent, license or otherwise share information with unaffiliated parties except as explained in this privacy policy.
Consent Given/Transaction Processing
We may disclose personal information about you to third parties with your consent. Consent is sometimes implicit, as in the disclosure of personal information to third-parties who complete transactions or perform services on our behalf.
To the Primary Account Holder
The primary account holder (party financially responsible for the account) is obliged to inform all wireless device users (either regular, casual or one time user) about the application installed to its equipment and its ability to track the user. If primary account holder is employer of the user, or a formal representative of the user’s employer; the primary account holder has no right to access user’s statistics and tracks if they cover employee’s non working time. However he can require from the employee to print or copy his tracks records related to the working period.
This solution is not designed and neither can be used for unauthorized people tracking. Any attempt for unauthorized tracking will lead to primary and secondary account cancellation and termination of the services ordered by primary account holder. The termination of TLV services might be permanent and no representative of the entity whose account has been cancelled for such reason has right to enforce TLV to reactivate the account. If the application is intently used for such illegal activity, TLV can provide collected information to the police or legal representatives in order to inflict sanctions to the person responsible for this activity.
The solution is not designed and dedicated for tracking of people who are not informed they are tracked (e.g. police suspect tracking, private detective activities, espionage etc.). If any of these activities will happen, TLV will terminate all services provided to entity represented by primary account holder, and will provide none of the collected data. The entity can require collected data only by contacting legal authorities of the country where TLV’s headquarter is based, and the data will be delivered based on local court or police order in compliance with international protection of human rights. In this case TLV does not guarantee, it will store the gathered data any more. TLV can terminate the service (even permanently) to any entity that is suspected of tracking people who are not informed they are tracked.
We may disclose personal information of an account user to the primary account holder, especially if lost or forgotten passwords or login details. The primary account holder is then responsible to any information usage according to local legislation and laws.
Third Party Services or Third Party Service Providers
If you take advantage of a third party's services or products offered through the use of our Services, we may disclose your personal information to such unaffiliated third parties. These entities may use this information that you provide in the course of your use of TLV's services (including your nicknames, name, telephone numbers, email and mailing addresses) to promote their products and services to you. Any such personal information that a third party uses will be subject to their applicable privacy policies.
Some of our Services and functionality are provided in conjunction with third party service providers. These third party service providers process personal information on our behalf and are obligated to process such information in compliance with this privacy policy and other appropriate security and confidentiality measures.
Legal Processes
We may comply with police departments, court orders or other legal processes for any of the information about you in our possession, and we may use such information to establish or exercise yours, ours, or others' legal rights, or to defend against legal claims.
Business Transfers
Information about you in our possession may be disclosed as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which your personal information would be transferred as one of the business assets of the company. TLV does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this policy. But if this unlikely situation occurs, TLV will carry out maximum effort to bind new owner with duty to inform users about possible changes a reasonable time before the Privacy Policy would be changed.
International Users
Information that we collect about you may also be transferred among our various divisions and affiliated companies around the world, which may involve transfer from countries within the European Union (EU) and Switzerland to countries outside the EU. By allowing TLV to collect this information about you, you consent to these transfers, including transborder transmission of data covered by this privacy policy. As a result, that country's courts, governments or law enforcement agencies could obtain disclosure of such information under that country's laws. The term “affiliated companies” also covers our partners who provide us cloud or hosting services.
Security and Retention of Your Information
TLV has implemented various physical, electronic and procedural safeguards to protect the confidentiality and security of personal information under our control. For instance, TLV limits access to TLV systems that store such information to authorized personnel. GPS Floto also employs the Secure Sockets Layer (SSL) protocol to protect your personal information on our website.
While TLV maintains a multitude of security measures to prevent unauthorized access to or disclosure of your personal information, no security measures are absolute or wholly guaranteed. TLV will make reasonable attempts to notify you if it determines there were unauthorized acts by third parties that violate the law or this policy, or other security breaches, or where otherwise required by law.
TLV will maintain your personal information for as long as a business need exists, or as required by applicable laws, regulations, or government orders. When we dispose of personal information, we use commercially reasonable procedures to erase or render it unreadable. If you no longer want TLV to use your information to provide you with the Services, you may close your account and TLV will delete the information it holds about you unless we need to retain and use your information to comply with our legal obligations, to resolve disputes, to enforce our agreements or as otherwise permitted by law.
Children’s Privacy
TLV will not knowingly request or collect personal information from any person under 18 years of age without prior verifiable parental or legal guardian consent. If, however, you authorize a child to use our Services or products by providing them a device associated with your GPS Floto service, any personal information associated with such use will be treated as your information in accordance with this policy. TLV encourages parents to be involved in the online activities (including wireless Internet browsing) of their children to ensure that no information is collected from a child without parental approval.
Customers are entitled to request information concerning whether a business has disclosed personal information to any affiliated companies or third parties for their direct marketing purposes. Customers are further entitled to request access to their personal information under TLV's control. To protect your privacy and security, TLV will take reasonable steps to verify your identity before providing you access or making corrections. Good faith efforts to resolve requests to correct inaccuracies in personal information will be made by TLV, except where the request is unreasonable. As stated in this privacy policy, TLV will not sell or share your personal information with third parties for their direct marketing purposes without your consent. Customers who wish to request further information about our compliance with this law or have questions or concerns about our privacy practices and policies may contact us at info@gpsfloto.com or write to: TLV s.r.o., Pitterova 7, Prague 130 00, Czech Republic
Third Party Software and Services
GPS Floto integrates software and services from various third party vendors in its solution. You agree to accept all Privacy Policy defined by those third parties listed at the end of the document.
Changes to this Policy
TLV may from time to time update this privacy policy, and we encourage you to periodically review this privacy policy to be informed of the latest changes. In the event that TLV merges with, or is acquired by another company, a change to this privacy policy may result. Whenever a change to this policy is significant, we will place a prominent notice on this website, at least 30 days before the effective date.
Other Agreements
TLV may enter into written product or Service agreements with customers that contain specific provisions related to confidentiality, security or other handling of information. If this privacy policy conflicts with any provision of those terms and agreements (both EU and international), those terms and agreements govern to the extent of the inconsistency. In all other instances, the terms of this privacy policy apply.
Governing Law
By choosing to visit this website, run GPS Floto application or otherwise provide information to TLV, you agree that any dispute over privacy or the terms contained in this privacy policy will be governed by the law of The Czech Republic. You also agree to arbitrate such disputes and to abide by any limitation on damages contained in our Terms of Use, Terms and Conditions of Service, or other applicable agreement we have with you.
How we transfer information we collect internationally
We collect information globally and primarily store that information in the Czech Republic. We transfer, process and store your information outside of your country of residence, to wherever we or our third-party service providers operate for the purpose of providing you the Services. Whenever we transfer your information, we take steps to protect it. We make use of standard contractual data protection clauses, which have been approved by the European Commission.
How to access and control your information
You have the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format. Below, we describe the tools and processes for making these requests. You can exercise some of the choices by logging into your web account and using settings available within the account. Where the Services are administered for you by an administrator (see "Notice to End Users" below), you may need to contact your administrator to assist with your requests first. For all other requests, you may contact us as provided in the Contact Information section below to request assistance.
Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.

Deactivate your account

For example, you can remove content that contains information about you within your profile settings. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.
Request that we stop using your information
In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don't have the appropriate rights to do so. For example, if you believe a Services account was created for you without your permission or you are no longer an active user, you can request that we delete your account as provided in this policy. Where you gave us consent to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time. Send "Do Not Track" Signals
Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services do not currently respond to browser DNT signals. You can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving marketing from us as described above.
Data portability
Data portability is the ability to obtain some of your information in a format you can move from one service provider to another (for instance, when you transfer your mobile phone number to another carrier). Depending on the context, this applies to some of your information, but not to all of your information. Should you request it, we will provide you with an electronic file of your basic account information.
